The Bode City Council met in regular session June 1, 2026, at 5:30PM in the council chambers. All members were present. Also, present Jeff Marsh representing New Cooperative, Tom Madden joined us via phone. Mayor Miller called the meeting to order. A motion was made by Fulwider, second by Hasfjord to approve the agenda as posted. All ayes, motion carried. A motion was made by Fulwider, second by McKenna to approve he minutes of the May 4th meeting as published. All ayes, motion carried.

This being the time and place for the public hearing regarding New Cooperative adding an additional anhydrous ammonia storage tank at 12 Humboldt Ave. Mayor Miller called for any oral or written objections disputing this. There were none. Jeff Marsh informed the council that all setback requirements will be met as well as the DNR requirements. Following discussion, a motion was made by Fulwider, second by McKenna to approve this. All ayes, motion carried.

The council reviewed the Certificate of Substantial Completion from Tom Madden our engineer, for the sewer project. This certificate states the work has been inspected and found to be substantially complete as of December 22, 2025, for Doyle Construction. Council member Fulwider informed Tom that the road patches that were done during the project, especially near 4th Street and Humboldt Ave, are very rough. Tom will get a hold of the contractor to have this area corrected; he also stated that the city has two years of warranty on this project and should look at these areas by the spring of 2027. Following discussion, a motion was made by Fulwider, second by McCart to approve this. All ayes, motion carried.

The council reviewed the Notice of acceptability of work for the Phase 1 Sanitary Sewer Collection and wastewater Treatment System improvements with Doyle Construction as the contractor. This notice states the engineer hereby gives notice that the engineer recommends final payment to Doyle Construction with the notice date being May 1, 2026. Following discussion, a motion was made by Fulwider, second by Hasfjord to approve this. All ayes, motion carried.

The council reviewed Change order #4 for the Phase 1 Sanitary Sewer Collection and wastewater Treatment System improvements. This order adjusts contract quantities to match installed quantities, remobilization to repair work that was completed, and adjust the final completion date to May 1, 2026. Following discussion, a motion was made by Hasfjord, second by McCart to approve this change order. All ayes, motion carried.

The council reviewed the final Payment Certificate for the Phase 1 Sanitary Sewer Collection project in the amount of 67,139.59 to Doyle Construction. Following discussion, a motion was made by  McCart, second by Fulwider to approve this payment. All ayes, motion carried.

The council reviewed the Final Davis-Bacon Compliance Report this report is submitted to the Iowa Finance Authority for the Sewer Project once the project is approved for substantially completion.

A motion was made by Fulwider, second Hasfjord to approve the CDBG Req #11 in the amount of $67,838.59 for the Sewer Project this includes $699 to Midas Council of Government and $67,139.59 to Doyle Construction. All ayes, motion carried.

A motion was made by Hasfjord, second by McCart to open a second account at West Iowa Bank, this account will be utilized to make online payments when necessary and will have a $2000 limit. All ayes, motion carried.

A motion was made by Fulwider, second by McCart to continue to pay Derek Dugans Health Insurance in full, the amount is $663 per month. This will be revisited in August. All ayes, motion carried.

A motion was made by Hasfjord, second by Fulwider to approve a cigarette permit to GiGi’s. All ayes, motion carried.

A motion was made by Tepner, second by McCart to change the mowing rate from $75 per lot to $200 per lot. This will change the Resolution setting city service rates. All ayes, motion carried.

A motion was made by McCart, second by Hasfjord to approve a new modem for city hall, that has a more secure firewall. This will cost an additional $10 per month. All ayes, motion carried.

A motion was made by Hasfjord, second by McKenna to set the next regular meeting as July 6. All ayes, motion carried.
