The Bode City Council met in regular session Monday February 3, 2025, at 5:30PM in the council chambers. Council members Fulwider, Miller, McKenna, and Tepner were present, absent Hasfjord. Also, present Jim Fischer. Mayor Peterson called the meeting to order; a motion was made by Tepner, seconded by Miller to approve the agenda as posted. All ayes, motion carried. A motion was made by Miller, second by Tepner to approve the minutes of the previous meeting as published. All ayes, motion carried.

The council was shown pictures of a nuisance property. Following discussion, a motion was made by Fulwider, second by Miller to have the city contact our attorney. The city will proceed with abatement at the city attorneys’ recommendations. All ayes, motion carried.

A motion was made by Tepner, second by Miller to approve Dorsey & Whitney to provide limited bond counsel services to the city regarding the SRF Sanitary Sewer System Improvement Project. These services will provide limited legal services related to the financing of the project through the SRF Program. The Borrower has let the contract (the “Bid Letting”) for the construction of the Project and will enter into a long-term loan (the “Bond Issuance”) in the approximate principal amount of $975,000 to finance construction of the Project. All ayes, motion carried.

 

Council Member Miller introduced the resolution hereinafter next set out and moved its adoption, seconded by Council Member Tepner; and after due consideration thereof by the Council, the Mayor put the question upon the adoption of the said resolution and the roll being called, the following named Council Members voted:

Ayes:  Fulwider, Mckenna, Miller, and Tepner

Nays:  None

Absent: Hasfjord

Whereupon, the Mayor declared the resolution duly adopted as follows: Resolution to fix a date for a public hearing on proposal to enter into a Sewer Revenue Loan and Disbursement Agreement and to borrow money thereunder in a principal amount not to exceed $975,000. The public hearing is set for March 3, 2025 @ 5:30PM in the Bode City Hall, for the purpose of instituting proceedings and taking action to enter into a loan and disbursement agreement (the “Agreement”) and to borrow money thereunder in a principal amount not to exceed $975,000, for the purpose of paying the cost, to that extent, of planning, designing and constructing improvements and extensions to the Municipal Sanitary Sewer System (the “Utility”) of the City.

Following review of sewer rates from Speer financial, it was advised to add $50 per account each quarter for debt reduction starting July 1, 2025. This fee will increase to $135 per account each quarter on July 7, 2027. A motion was made by Miller, second by Fulwider to set public hearing:

SEWER RATES: 6-4-10 RATE OF SEWER AND MANNER OF PAYMENT. The rate of sewer rent (100% of water use) will also add the debt reduction prices above as recommended.

A public Hearing for Sewer rates will be set for March 3 at 5:45PM in the Bode City Hall.  

Following review of Water rates from Speer financial it was advised to increase the usage rate of water by 2% annually starting on July 1, 2028. A motion was made by Miller second by Fulwider to set Public Hearing:

            Utility Billing Charges, WATER RATES, section 6-5-8 of the city WATER RATES: Water             usage shall be billed quarterly. Water shall be furnished at the following rates per             property services within the city limits:

            The first 1,000 gallons                    55.00/quarterly

            All over 1,000 gallons                     2.00 per 1,000 gallons

            Sewer Rates: 100 % of water

The City will increase the usage rate of water by 2% annually starting on    July 1, 2028

A Public Hearing for Water rates will be set for March 3 at 6PM in the Bode City Hall.

A motion was made by Miller, second by Paula to approve “GiGi’s Mercantile Class B retail Alcohol License. All ayes, motion carried.

A motion was made by Miller, second by Tepner to approve the Bode Fireman’s Association a 5-day liquor license for the annual Fire Departments Fun Night which is set for April 5th. All ayes, motion carried.

The council reviewed the Max Levy rate for the 2025-26 City Budget.
